"GREAT SUMMER GAME 2019 - PHOTO CONTEST WITH CROISIEUROPE"

Article 1: Organization

 

The French, simplified joint-stock company ALSACE-CROISIERES – CROISIEUROPE, with a capital of € 2,000,000, whose headquarters are located at 12 rue de la Division Leclerc, 67080 Strasbourg, France, and registered under the number 998 348 601 at the Registry of Trade and Companies in Strasbourg, hereinafter known as the “Organizer,” is sponsoring a contest from 4:00 p.m. June 21, 2019 to midnight September 30, 2019 (no purchase necessary).


Article 2: Participants

 

This contest does not require any purchase and is open to any person over 18 years old who has a valid, personal access to the Internet, a valid email address, and a valid account on www.facebook.com on the date the contest begins. 

 

Anyone who does not fulfill the conditions cited above, employees of the “Organizer,” or who provided direct or indirect help in the concept, carrying out, or management of the contest, as well as their spouses or partners or members of their families (direct ascendants or descendants or other family members living with them or not) are excluded from participating.

 

The "Organizer" reserves the right to ask any participant to substantiate the above-cited terms. Any person who does not fulfill the conditions or who refuses to substantiate the conditions will be excluded from the contest and will not be able to claim their prize if they win.

 

Only one submission is authorized per person (same name, same address). The “Organizer” reserves the right to proceed with any verifications regarding compliance with this rule.

 

Participation in the contest implies acceptance of these rules.


Article 3: Terms and conditions for participating

Participation in the contest will be carried out according to the following terms and conditions: Between June 21, 2019 and August 31, 2019, take a photo that symbolizes the cruise (with a member of the crew, a CroisiEurope ship, its equipment, etc.) - Between June 21, 2019 and August 31, 2019: send the photo to CroisiEurope using this email: web@croisieurope.com - Between September 1, 2019 and September 30, 2019: the top 20 photos chosen by the jury will be shared in a dedicated album on the CroisiEurope and CroisiEuropeRiverCruises Facebook pages - Between September 1, 2019 and September 30, 2019: vote by the Facebook community to decide between the photos: the three photos that accumulate the most “likes” will win a prize. 

 

Any participation done through the email address of a third party will not be valid.

 

In the case of multiple submissions by the same participant, none of the submissions will be valid.

 

Each participant can only send one photo.

 

Any submission that does not comply with the terms and conditions stated in these rules will not be valid. Any participant suspected of fraud can be removed from the contest by the “Organizer” without explanation. Any incomplete, erroneous, illegible identification or incomplete submission⁠ (voluntary or not⁠) or a submission created in a format not cited in these rules will not be valid. The same consequence will apply in the event of multiple submissions.


Article 4: Prizes

 

The prizes offered are as follows:

 

• 1st Place: Five-day cruise in Venice for two people Ref. VEN_PP (Double-occupancy cabin – Main Deck –Transfers not included – 2019 departure) (€589 value, including taxes)

Details: This prize is nominative and can only be used by the winner. It cannot be modified, cashed in, exchanged, or given to another person. The prize for first place has a minimum value of €589.

 

• 2nd Place: Four-day tour to discover the Christmas Markets in Alsace, France, for two people Ref. MNO_PP (Double-occupancy cabin – Main Deck –Transfers not included – 2019 departure) (€349 value, including taxes)

Details: This prize is nominative and can only be used by the winner. It cannot be modified, cashed in, exchanged, or given to another person. The prize for second place has a minimum value of €349.

 

• 3rd Place: Weekend getaway for two people on board a standard ship Ref. THD or THL or AWT or THE or TMH or THX or equivalent cruise (Double-occupancy cabin – Main Deck – Transfers not included – 2019 departure) (€155 value, including taxes). 

Details: This prize is nominative and can only be used by the winner. It cannot be modified, cashed in, exchanged, or given to another person. The prize for third place has a minimum value of €155.

 

Total value of prizes: €1,093, including taxes.

 

The value of the prizes was determined when these rules were written and cannot be contested as to their estimation.

 

Any expenses incurred subsequent to the contest, specifically for the retaining and use of the prizes, are under the full responsibility of the winners.

 

Article 5: Choosing winners

 

On September 1, 2019, a jury composed of the employees in the Alsace Croisières – CroisiEurope E-commerce Department will choose approximately 20 photos that will be posted in a dedicated album on the CroisiEurope and CroisiEuropeRiverCruises Facebook pages to be voted on by the Facebook community between September 1, 2019 and September 30, 2019. 

 

Each of the winners, decided by the highest number of “likes” for their photo on Facebook, will receive a prize as stated in the Prize section.

 

The “Organizer” reserves the discretionary right to modify the prizes in the case of an event beyond its control and will propose to the winners other prizes of the same or superior nature or value.

 

The “Organizer” will not be held liable whatsoever for cases of force majeure or events beyond its control if it must cancel this contest.

 

In the event of a tie, the winner will be chosen by random draw.

 

Date for choice of winners: October 1, 2019.


Article 6: Announcing winners

 

• Winners will be notified via the email given when they entered the contest • Only the contest winners will be informed personally of the results of their participation. All other participants will not be informed individually.

 

The contest winners will be notified of the results of their participation within two months after the end of the contest through an email from CroisiEurope so as to obtain each winner’s full information (last name, first name, mailing address, telephone, email, birth date), which is required to receive the prize.

 

All winners who do not respond within seven (7) days following the transmission of the email by CroisiEurope will be deemed as having relinquished their prize.

 

The “Organizer” is under no obligation to carry out a specific search in order to contact any winner who has not responded by the end of the deadline cited above.


Article 7: Receiving prizes

 

• Prizes will be sent to the mailing addresses given by the participants • The winners will receive their prizes at their mailing address within 15 days (not including weekends and holidays) or by email once the winner has made themselves known after notification on the CroisiEurope Facebook pages.

 

The “Organizer” will not be held liable for non-receipt of a prize because of inexact information provided by the winner.

 

If a prize cannot be delivered to the winner for any reason whatsoever, outside of the control of the “Organizer” (the winner has moved without updating their address, etc.), the prize will remain available to the winner for 15 days. Beyond these 15 days, the prize will remain the definitive property of the “Organizer.”

 

If the prize is returned because it cannot be delivered, it will remain available to the winner for 15 days. After this time has expired, the winner will no longer be able to claim the prize.

 

The winners will accept the prizes as they are proposed, without the possibility to exchange them for cash or other goods or services whatsoever, nor the possibility to transfer the prizes to third parties. In addition, these prizes cannot be the subject of any demands for compensation. The “Organizer” reserves the right, in the case of an event not under their control, and specifically related to its suppliers or unforeseeable circumstances, to replace the announced prizes by prizes with equivalent values. The winner will be informed of any possible changes.

 

Article 8: Use of participants’ personal data

 

Participants’ information will be saved and used by the “Organizer” to record their participation in the contest and enable attribution of the prizes.

 

Participants can, for legitimate reasons, oppose the processing of their personal data given in the framework of this contest. They also have the right to oppose the use of their data for sales prospection, outside of participation in the contest, and they can assert this right as soon as they have registered for the contest by writing to the “Organizer” at the address cited in Article 1. 

 

The winner(s) authorize(s) the “Organizer” to use their personal information (first and last name) for advertising or public relations purposes on any type of medium whatsoever, without the right to compensation, claim, or any benefit other than collecting their prizes. In compliance with the current French data laws, as well as the European Data Protection Act dated April 27, 2016, participants can assert their right to access, rectification, or deletion of their data; limitation of processing; the right to data portability; the right to opposition; and the right to retract consent by sending a letter to the “Organizer” at the address cited in Article 1.


Article 9: Contest rules

 

Rules have been filed at SELARL ACTA – PIERSON et ASSOCIES, a court bailiff located at 15 rue de Sarre, BP15126, 57074 METZ Cedex 3, FRANCE.

They can be sent free of charge by the “Organizer” to anyone who requests it.

 

The “Organizer” reserves the right to extend, shorten, modify, or cancel the contest at any time, specifically in the event of force majeure, without any liability of compensation to participants. Rules modified by addendum(s) will be filed, if necessary, at SELARL ACTA – PIERSON et ASSOCIES, a court bailiff located at 15 rue de Sarre, BP15126, 57074 METZ Cedex 3, FRANCE.


Article 10: Patents and intellectual property

 

All or partial reproduction, representation, or use of the elements constituting the contest, including these rules, is strictly prohibited. Any brands, logos, texts, images, videos, and other distinctive symbols or signs reproduced on the website, as well as the websites that can be accessed through hyperlinks, are the exclusive property of the copyright owners and are protected as such by the provisions under the French Intellectual Property Law, applicable worldwide. Unauthorized reproduction constitutes an infringement subject to criminal action.


Article 11: Liability

 

The “Organizer” cannot be held liable in the event of force majeure or unforeseen circumstances out of their control. The “Organizer” cannot be held liable for delays, loss, theft, damage to mail, or lack of legibility of stamps due to postal service issues. The "Organizer" cannot be held liable, and no legal action can be engaged against the "Organizer" in the case of force majeure events (strikes, bad weather, etc.) depriving partially or totally the possibility for participants to take part in the contest or the winners to benefit from their prizes.

 

The “Organizer” and their service providers, suppliers, and partners cannot be held liable for possible incidents that could happen during the use of the prizes by the winners or their guests from the moment the winners claim their prizes.

 

Also, the “Organizer” and their service providers, suppliers, and partners cannot be held liable for the loss or theft of the winners’ prizes from the moment the winners

claim their prizes. All additional costs needed to claim the prizes are the entire responsibility of the winners, who cannot request compensation of any kind from the “Organizer,” their service providers, suppliers, or partners.

 

The contest is not managed or sponsored by Facebook, and the “Organizer” releases them of any liability.


Article 12: Litigation & complaints

 

These rules are governed by French law. The “Organizer” reserves the right to decide on, without any power to appeal, any difficulty that arises about the interpretation or application of these rules, with the understanding that no challenge will be allowed, especially regarding the terms and conditions of the contest, results, prizes, or their receipt, after one month following the end of the contest. Except in the event of express errors, it is agreed that the information resulting from the “Organizer’s” contest systems has probative force in any litigation when it comes to the connection and electronic processing of this information relative to the contest.

 

Any complaints must be addressed to the “Organizer” within one month of the end date of the contest. 

 

Beyond this date, no complaints will be accepted. Participation in the contest implies acceptance of these rules. 


Article 13: Agreement of proof

 

By express agreement between the participant and the “Organizer,” only the “Organizer’s” computer files and systems shall be deemed authentic.

 

The computer logs conserved in the “Organizer’s” IT system, under reasonably secure and reliable conditions, are considered as proof of the relationship and communication that occurred between the “Organizer” and the participant.

 

As a consequence, it is agreed that, apart manifest error, the “Organizer” can rely upon⁠—specifically as means of proof of any act, fact, or omission⁠—the programs, data, files, logs, operations, and other elements (such as monitoring or other status reports) as such or in a computer or electronic format or medium, established, received, or conserved directly or indirectly by the “Organizer,” particularly in its computer systems.

 

The considered elements constitute proof in this manner, and if they are produced as a means of proof by the “Organizer” in any legal or other proceedings, they will be admissible, valid, and binding between the parties equally, under the same conditions, and with the same probative force as any other hand-written document that is drafted, received or retained.

 

Any type of operation performed using an ID and code given to a participant following registration are assumed, irrefutably, to have been carried out under the participant’s responsibility.
